Non-recourse funding

IC2 and its clients formalise their contractual relationship through a Funding Agreement, which will provide that IC2’s remuneration will consist in a portion of the proceeds of any favourable arbitral award, or any settlement agreement. Thus, a client will not owe IC2 a remuneration if no cash is effectively collected from the debtor. A non-monetised resolution of the dispute can fit within a funding scheme, if IC2 and its client agree on a formula giving such non-monetised settlement a cash equivalent.

Funding is without recourse to the client: this means that the Fund’s investment remains at risk for as long as no cash has been collected.
